We the People of the Army of Club Penguin, in Order to form a more perfect Union,
establish Justice, insure domestic Tranquility, provide for the common
defence, promote the general Welfare, and secure the Blessings of Liberty to
ourselves and our Posterity, do ordain and establish this Constitution for the Army of Club Penguin.

Article 1 – The Legislative Branch
Section 1 – The Legislature
All legislative Powers herein granted shall be vested in a Senate of the Army Of Club Penguin and the Leader of the aforementioned army.
Section 2 – The Senate
The Senate of the Army Of Club Penguin shall be composed of sixteen Senators that are members of the Army Of Club Penguin, elected by the people thereof, for four months; and each Senator shall have one vote. The electors in the army shall have the qualifications requisite for electing the candidates. These are outlined in the next section.
Section 3 – Elections, Meetings
The Times, Places and Manner of holding Elections for Senators can be frequently changed at the discretion of the president. The current rules which must be followed at elections are as follows.
- Electors must be a member of the Army Of Club Penguin.
- Only one vote per voter.
- Any found cases of cheating on behalf of a candidate will result in the immediate disqualification of the candidate.
- If there is debate as to whether offences mentioned above were being commited, the leader ranks will vote among themselves. If there is a tied decision, the leader(s) will make the casting vote. If there is more than one leader, and, in the rare case, there is disagreement between them, the members involved will be brought before the Supreme Court of the Army of Club Penguin to plead their cases.
- There will be elections every 3 months, and unless the Branch gets dissolved by order of the President, it is always active.
- Certain Senators will be placed on Committees in order to focus on certain issues.
- The format in which the Elections will be held is laid out in Section 4 of this article.
- Rules regarding allowing advertisements etc. will be decided at the time by the incumbent administration.
Section 4 – Senate Election Format
To ensure the equal distribution of representation amongst the army, there will be brackets for voting. These brackets will be based on rank. They are as follows:
Bracket 1 : Division General to Major General
Bracket 2: Brigadier General to Colonel
Bracket 3 : Lt. Colonel to 1st Lieutenant
Bracket 4: 2nd Lieutenant to Corporal
4 Candidates will be chosen from each of the brackets. You can only vote for people in your rank bracket. To become a candidate you must follow the rules laid out in Section 3 of this Article.
Section 5 – Legislative process, Leadership Veto
Every Bill which shall have passed the Senate with a 2/3 majority, shall, before it becomes a Law, be presented to the Leader of the Army Of Club Penguin. If he approves he shall sign it, and it shall become law. But if not, he shall return it, with his Objections to the senate from whence it originated. If after such Reconsideration two thirds of the senateshall agree to pass the Bill, it shall be sent, together with the Objections, back to the Leader(s). If he disagrees again, it is returned to the Senate with his objections and the cycle is repeated. When it is returned to the Leader(s) for the third time, and it is rejected, it is final and cannot be brought back again. If another bill is created, and the leader(s) deem it to be too similar to the bill which was rejected, it shall become void. In all such Cases the Votes of the senate shall be determined by Yeas and Nays.
The Leader does also have the option of a Leadership Veto. If there is a bill that is not passed by 75% of the Senate and the Leader determines the Bill to be sound, he will Veto the decision and make it law. This is however,only a limited veto. This meaning, a senate majority of 85% can override a LeadershipVeto, and the Bill will be discarded and no longer stand.
Section 6 – Powers of the senate
The senate has the power to:
Create bills and put forward ideas that will benefit the Army Of Club Penguin.
Make Rules for the Government and Land Forces. All rules and bills suggested by the Senate must be passed through and approved by the leader(s) of the Army Of Club Penguin, as mentioned in Article 1, Section 4.
Be able to override a Leadership Veto as mentioned in Article 1, Section 5.
Able to dismiss the current Senate President from office with a unanimous (75%) vote in favor.
Able to fire the Ambassador of the Army of Club Penguin with a 75% vote in favor.
Section 7 – Limits on the Senate
No decisions can be made by the Senate without the approval of the leader(s) of the Army Of Club Penguin. Any such attempt will lead to an investigation by leaders, and any persons found to be involved will be dealt with at the discretion of the leader(s).
Section 8 – Citizenship
There will be elections every 3 months, and unless the Branch gets dissolved by order of the President, it is always active.
The President will be picked by the current Leader of the Army of Club Penguin.
Either the Leader or the President will then pick the Vice-President.
Only citizens of the Army Of Club Penguin are allowed to run.
Certain Senators will be placed on Committees in order to focus on certain issues.
Article 2 – The Executive Branch
Section 1 – The Leader
This person is chosen by a retiring leader, unless the retiring leader would like an election. The exact manner in which he/she can be elected is stated in Section 2 of this Article. Any leader can be impeached if either Boomer, Oagal, or Shab deem them unfit to lead, or if the army as a whole deems them unfit to lead. They can overrule a decision by the president if they feel it is necessary. The executive Power shall be vested in a Leader of the Army Of Club Penguin and his/her senate.
Section 2 – Leadership succession
As has several democratic ideals, the policy for the succession of a leader is a restricted vote. Only soldiers who have reached the mod line and selected others will vote on who the next leader will be. The current leader will choose 2 or more soldiers of his/her choice to be voted on. There must be more than one person selected by the leader to be voted on, but there is no restriction beyond that.
Section 3 – Dismissal from leadership
The Leader,Co-Leaders and all Officers of the Army Of Club Penguin, shall be removed from office on impeachment for, and conviction of: Treason, Bribery, or other high Crimes and Misdemeanors. High ranks may contact Boomer, Shab, and/or Oagalthorp for assistance, and at either’s discretion they can decide to remove the soldiers in question from office. The procedure following will consist of the Leadership succession stages mentioned in Section 2 of this Article.
Section 4 – The President
This person can be impeached (fired from his/her position) if there is an unanimous (75%) decision by the Senate. They are picked by the leader, or can be the leader, without an election, however if a President is fired by a unanimous vote from the Senate, he/she cannot ever receive the position again.
Section 5 – Vice President
This person can either be chosen by the President, the Leader, or elected depending on the Leader’s wishes. The Vice President has no limit for the time he/she can serve. The only way to get a new Vice President is if the President/Leader fires him/her or if he/she is impeached, with a 75% vote by the Senate.
Article 3 – Foreign Policy
Section 1 – Allies and Enemies
The policy of the Army Of Club Penguin regarding Allies and Enemies is as follows:
Subsection 1:
Since tracking down all the Small Armies that want to be allies with us and adding them to the allies page is tedious, time-consuming, and takes up a lot of space, the ACP’s policy with Small Armies being allies will be a “You don’t attack us, we don’t attack you” policy. This means:

All Small Armies who wish to be allies with us are our allies. They need not apply, for as long as they don’t attack us, they will not be attacked by us.

All Small Armies that are our allies will not be put on the Allies page, because as long as they don’t attack us, we won’t be provoked to attack them. Therefore, a page reminding us not to attack them is not needed.

Any Small Armies that attack the ACP will be attacked themselves by that group, however, no large scale invasion will be launched on them unless they become a serious problem, in which further action will be taken.
Subsection 2:
The benefits that Small Armies who choose to be our allies will receive are as follows:

They, provided they own no land of their own, will be able to use our land for recruitment/battles, provided they do not claim it as their own.

If the ACP attacks a server that they share with the army being attacked, they will still get to claim that server as their own.
Subsection 3:
The ACP is NOT, however, obliged to:

Give troops.
-
Help that army recruit (unless the leader agrees to help with such things).

Help that army in a conflict, except in special circumstances (ex. A large army is attacking that small army simply out of hate/greed).

Section 2 – Conditions of Alliances
All allies agree to the following conditions:
We, the Army of Club Penguin, control our servers, but we let allies and citizens in. Anyone can come in, except groups of enemy armies. No one is allowed to set up a base there, unless we give them a Land Grant for a certain server. When we give a Land Grant, we still control the server, but the other army can control it also. If we go to war with that army, the Land Grant can be ended, and we get the entire server back.
Section 3 – Ambassador
The Leader can decide whether there is an Ambassador or not. The Ambassador helps with the passing of laws that has to do with other armies/governments, and also interacts with other armies when the need arises. The Ambassador is elected by the people and can be fired immediately by the Leader if he/she deems necessary, or by the Senate if there is a 75% majority in favor. If an Ambassador is fired by the Senate, he/she cannot run for Ambassador again.
Article 4 – Rights of the people
Section 1 -Rights of the citizens of the Army of Club Penguin
The citizens of The Army Of Club Penguin are entitled to the right of Speech without limitation within reason. The exceptions to this rule are laid out in Section 3 of this Article. The citizens of The Army Of Club Penguin are entitled to the right to express all their opinions, regardless of whether or not it agrees with the Agenda of the incumbent government.
Section 2 – Responsibilities of the citizens of The Army of Club Penguin
Whilst the citizens of the Army of Club Penguin are entitiled to their rights, they also have responsibilities. This includes following and/or enforcing the rules of the Chat and to keep an honourable reputation for the Army of Club Penguin when they are representing them. Any misdemeanours in relation to this will be dealt with by the Leader(s) at his/her discretion.
All soldiers of the Army of Club Penguin must make the following oath, known as “The Soldier’s Pledge.”
The Oath of a Soldier
I, a humble soldier,
promise to uphold the ways of The Soldier’s Pledge
and to live my virtual life by these rules.
The Rules of a Soldier
1. Remain loyal to your army.
2. Follow your army’s individual rules
3. Do not omit yourself to racism
4. Do not omit yourself to sexism
5. Do not omit yourself to being prejudiced to any ethnicity.
6. Avoid fighting with your fellow soldiers or anybody else.
7. Ask before you set foot on enemy territory.
8. Look to all armies except yours as rivals.
9. An honorable solider will write a retirement speech. A cowardly one will quit and write nothing.
Section 3 – Limitations on Freedom of Speech
It shall be an offence for a person on any site related to or owned by the Army of Club Penguin—
( a ) to publish or distribute written material,
( b ) to use words, behave or display written material—
( c ) to distribute, show or play a recording of visual images or sounds,
if the written material, words, behaviour, visual images or sounds, as the case may be, are threatening, abusive or insulting and are intended or, having regard to all the circumstances,are likely to stir up hatred. Any breaking of this can be dealt with at the discretion of the Leader(s).
Article 5 – Amendment procedure
The Senate, or any of the owner ranks in the current leadership deem necessary, they may propose an amendment to this constitution. Every amendment which shall have passed the Senate with a 2/3 majority, shall, before it becomes a Law, be presented to the Leader of the Army Of Club Penguin. If he approve he shall sign it, and it shall become law. But if not, he shall return it, with his Objections to the senate from whence it originated. If after such Reconsideration two thirds of that House shall agree to pass the amendment, it shall be sent, together with the Objections, back to the Leader(s). If he disagrees again, it is returned to the Senate with his objections and the cycle is repeated. When it is returned to the Leader(s) for the third time, and it is rejected, it is final and cannot be brought back again. If another amendment is created, and the leader(s) deem it to be too similar to the bill which was rejected, it shall become void. In all such Cases the Votes of the senate shall be determined by Yeas and Nays.
This Constitution, and the Laws of the Army Of Club Penguin which shall be made in pursuance thereof; and all Treaties made, or which shall be made, under the authority of the Army Of Club Penguin, shall be the supreme Law of the Land; and all its members shall be bound thereby.
